Please read these Terms of Use ("Terms") carefully before using the Platform mobile application ("App"). By downloading, installing, or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the Platform app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Age Requirement

You must be at least 13 years of age to use this App. If you are under 13, you may only use the App with the involvement and consent of a parent or guardian.

3. Description of Service

Platform is a train timetable application that provides real-time train departure information for Brisbane railway stations. The App displays the next available trains for your selected station(s).

Free Version: Allows you to track one (1) station.

Premium Version: Available via in-app purchase, allows you to track multiple stations and access additional features.

All timetable data is sourced from TransLink Open Data. Platform is an independent application and is not affiliated with, endorsed by, or connected to TransLink, Queensland Rail, or the Queensland Government.

4. Data Source and Accuracy

The App displays train timetable information sourced from TransLink Open Data. While we strive to provide accurate and up-to-date information, we do not control this data source and cannot guarantee its accuracy, completeness, or timeliness.

Important: The information provided is for informational purposes only. Always verify departure times, platform information, and service status at the station, on official TransLink signage, or through official Queensland Rail and TransLink channels before making travel decisions.

Platform and Nathan Benzie are not responsible for:

  • Inaccurate timetable information
  • Service cancellations, delays, or changes
  • Missed trains or appointments resulting from reliance on the App
  • Interruptions to the TransLink Open Data service

5. In-App Purchases

Premium features are available through in-app purchase, processed via the Apple App Store or Google Play Store.

Payment Terms:

  • Purchases are processed by Apple or Google, subject to their respective terms and conditions
  • Prices are displayed in Australian Dollars (AUD)
  • Payment will be charged to your App Store or Google Play account

Refunds:

  • Refund requests are handled by Apple or Google according to their refund policies
  • Contact the App Store or Google Play Store directly for refund requests
  • Your consumer rights under the Australian Consumer Law are not affected

6. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or other applicable law that cannot be excluded, restricted, or modified by agreement.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and obtain a refund, or to compensation for the drop in value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

7. User Responsibilities

As a user of the App, you agree to:

  • Provide accurate information when using the App
  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not use the App in any way that could damage, disable, or impair our servers or networks
  • Not use automated systems, bots, or scrapers to access the App without our permission
  • Not attempt to bypass, circumvent, or disable any payment mechanisms or premium features
  • Maintain the security of your device and account
  • Not submit false reports or malicious data

8. Service Availability

We do not guarantee that the App will be available at all times or that it will be error-free. The App may experience downtime due to:

  • Maintenance or updates to the App
  • Interruptions to the TransLink Open Data service
  • Technical issues beyond our control
  • Server maintenance or failures

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may also update the App to fix bugs, add new features, or improve performance.

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to design, code, graphics, logos, user interface, and software, are owned by Nathan Benzie and are protected by copyright, trademark, and other intellectual property laws.

The timetable data displayed in the App is owned by TransLink and the Queensland Government and is used under the TransLink Open Data terms.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

  • Copy, modify, or distribute the App or its content
  • Remove any copyright or proprietary notices
  • Create derivative works based on the App
  • Resell or commercially exploit the App

10. Third-Party Services

The App integrates with and relies upon the following third-party services:

  • TransLink Open Data - Source of train timetable information
  • Apple App Store / Google Play Store - Payment processing and app distribution

We are not responsible for the availability, accuracy, terms, or content of these third-party services. Your use of these services is subject to their respective terms and conditions.

11. Limitation of Liability

To the fullest extent permitted by law, Platform and Nathan Benzie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Missed trains, appointments, or connections due to inaccurate or outdated information
  • Loss of data or service interruptions
  • Any damages resulting from your use of or inability to use the App
  • Reliance on information provided by the App
  • Service changes, cancellations, or delays not reflected in the App

Where liability cannot be excluded under the Australian Consumer Law, our maximum liability is limited to, at our option:

  • Re-supply of the services; or
  • Payment of the cost of having the services supplied again; or
  • Refund of the purchase price paid for premium features

12. Indemnification

You agree to indemnify and hold harmless Nathan Benzie (trading as Platform) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or actions you take using the App

13. Privacy

Your use of the App is governed by our Privacy Policy, available at https://platformbrisbane.app/privacy.html. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

  • Posting the new Terms on this page and updating the "Last updated" date
  • Providing notice within the App (for material changes)

Your continued use of the App after such changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

15. Termination

Your Rights: You may stop using the App at any time by uninstalling it from your device.

Our Rights: We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the App or its features
  • Attempts to circumvent payment for premium features

If your access is terminated for breach of these Terms, you may not be entitled to a refund for any premium features purchased.

16. Dispute Resolution

If you have a complaint or dispute regarding the App, please contact us at [YOUR-EMAIL@DOMAIN.COM]. We will make reasonable efforts to resolve the issue within 14 days.

If we cannot resolve the dispute informally, you may pursue formal dispute resolution in accordance with the governing law provisions below.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

18. Acknowledgments

Train timetable data is provided by TransLink Open Data and is used in accordance with their terms of use. Platform is an independent application and is not affiliated with, endorsed by, or connected to:

  • TransLink
  • Queensland Rail
  • Queensland Government

TransLink and Queensland Rail trademarks, service marks, and logos are the property of their respective owners.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, such provision shall be severed and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nathan Benzie (trading as Platform) regarding your use of the App and supersede all prior agreements and understandings.
